Term of Use
These Terms of Use (“Terms”) govern your access to and use of the Anatomy Cloud platform, a cloud-based AI medical imaging service provided by IntelliGen Technology (“we”, “us”, “our”). By registering for or using our services, you (“you” or “user”) agree to be legally bound by these Terms, our Privacy Policy, and any applicable supplemental terms.
01. Eligibility
1.1. You may only use the Anatomy Cloud platform if you are:
- At least 18 years old or have reached the age of majority in your jurisdiction
- Duly authorized to act on behalf of a healthcare institution, research organization, or educational body (if registering on their behalf
1.2. By accessing the platform, you affirm that any personal or health data you upload or process has been lawfully obtained and, if required by law, accompanied by valid patient consent or IRB approval.
02. Account Registration and Security
2.1. You must register an account to access core platform functionalities. You agree to:
- Provide accurate, current, and complete registration information
- Keep your account credentials secure and confidential
- Immediately notify us if you suspect unauthorized access or account misuse
2.2. You are solely responsible for all activity conducted under your account. We reserve the right to suspend or terminate your account if we detect misuse or breach of these Terms.
03. Permitted Use and Restrictions
3.1. Permitted Use:
You may use the platform strictly for lawful purposes, including:
- Diagnostic visualization
- Medical education and training
- Clinical planning or research, in compliance with applicable law
3.2. Prohibited Activities:
You agree not to:
- Upload or transmit any unlawful, harmful, or offensive content
- Attempt to reverse-engineer, decompile, or interfere with the platform’s architecture or AI algorithms
- Use the platform to train non-authorized AI systems or extract data for unrelated machine learning purposes
- Circumvent access restrictions or security protocols
- Introduce malware, perform security testing (e.g., penetration tests), or disrupt services without authorization
- Use the platform for commercial resale or offer it as a third-party service unless explicitly authorized
04. Data Privacy and Protection
4.1. Compliance with Laws:
We process personal data and Protected Health Information (PHI) in accordance with:
- HIPAA (U.S. users and institutions)
- GDPR (EU/EEA users and data subjects)
- Other applicable local privacy regulations
4.2. Data Handling:
You are responsible for:
- Ensuring appropriate lawful basis (e.g., consent, contract, public interest) before uploading or sharing any personal or health data
- Anonymizing data when feasible and legally appropriate
- Informing patients or data subjects, where applicable, about how their data will be used
4.3. Security:
We implement reasonable administrative, technical, and physical safeguards to protect your data. For further details, refer to our Privacy Policy.
05. Intellectual Property
5.1. All software, features, design, algorithms, and documentation on the Anatomy Cloud platform are the intellectual property of IntelliGen Technology or its licensors.
5.2. You are granted a limited, non-exclusive, non-transferable, and revocable license to use the platform for the permitted purposes under these Terms.
5.3. You may not copy, modify, distribute, or exploit any part of the platform without our prior written permission.
06. Third-Party Services
6.1. The platform may integrate with third-party systems (e.g., PACS, EMR, cloud storage). We are not responsible for the availability or data processing practices of such third parties.
6.2. Where applicable, third-party terms may govern your use of integrated services.
07. Service Availability and Modifications
7.1. We strive to maintain platform uptime but do not guarantee uninterrupted access. Planned maintenance or updates may temporarily affect availability.
7.2. We reserve the right to modify, suspend, or discontinue any feature, tool, or service, with or without prior notice.
08. Termination
8.1. We may suspend or terminate your access if you:
- Violate these Terms or applicable laws
- Compromise the integrity or security of the platform
- Misuse your account or user data
8.2. You may terminate your account at any time by contacting our support team.
8.3. Upon termination, we will retain or delete your data in accordance with applicable laws and our data retention policy.
09. Disclaimers and Limitation of Liability
9.1. The Anatomy Cloud platform is provided “as is” and “as available” without warranties of any kind, express or implied.
9.2. We are not liable for any:
- Diagnostic errors, decisions, or outcomes based on visualizations generated via the platform
- Losses caused by unauthorized access to your account or uploaded content
- Indirect, incidental, or consequential damages arising from your use of the platform
9.3. In no event shall our total liability exceed the fees you paid for the service in the past 12 months.
10. Governing Law and Dispute Resolution
10.1. These Terms are governed by the laws of:
- Taiwan, unless otherwise agreed in writing
- Or your local jurisdiction, where applicable data protection or consumer laws require it
10.2. Any disputes shall be resolved via good-faith negotiation or arbitration where required by applicable law.
